Legal
Terms of Service.
What you get, what you owe, what we're not on the hook for. The long version of common sense.
Acceptance of these terms.
By accessing or using Feasibly (“the Service”), including through the website at feasibly.com.au, the MCP server, or any API endpoint, you agree to be bound by these Terms of Service.
What the Service is.
Feasibly provides automated property screening intelligence using publicly available government planning data. The Service is accessed through MCP-compatible AI clients (Claude, ChatGPT, Cursor, and others), a web-based screening tool, and REST API endpoints.
Indicative information, only.
All outputs generated by Feasibly are indicative screening information only. You acknowledge and agree that all outputs are:
- Generated by automated computational analysis of publicly available spatial and planning data;
- Produced without physical inspection of the subject site;
- Produced without assessment of site-specific conditions observable only through on-site inspection;
- Produced without a title search, covenant review, or encumbrance analysis;
- Produced without taking into account current market conditions, financial viability, or commercial feasibility;
- General in nature, for preliminary screening purposes only.
Not professional advice.
Feasibly does not provide professional planning, legal, architectural, surveying, financial, or investment advice. It is not a substitute for engaging qualified professionals.
Your obligations before acting.
Before making any property purchase, development, investment, or other decision in reliance on or informed by Feasibly outputs, you must:
- Engage a qualified town planner to assess the specific site and its planning controls;
- Consult a registered architect for design feasibility where relevant;
- Obtain legal advice from a qualified planning lawyer;
- Commission a survey to confirm lot boundaries, dimensions, and levels;
- Conduct a title search to identify covenants, easements, and encumbrances;
- Verify all information directly with the relevant council planning department;
- Undertake your own financial and commercial due diligence.
Account, API keys, you.
You are responsible for maintaining the confidentiality of your API key and account credentials. Do not share your API key with unauthorised parties. You are responsible for all activity that occurs under your account or API key.
Acceptable use.
- Use the Service for any unlawful purpose;
- Resell or redistribute Feasibly data without written authorisation;
- Attempt to reverse-engineer, scrape, or abuse the API;
- Exceed your plan's usage limits through automated means;
- Misrepresent Feasibly screening data as professional advice.
Subscription and billing.
Who you are contracting with. Feasibly is operated by Quantum Digital Plus Pty Ltd (ABN 51 661 806 024), an Australian proprietary company, trading as Feasibly. Payments are processed by Stripe and appear on your statement as FEASIBLY.
Prices and GST. All prices are in Australian dollars and exclude GST. Where GST applies, 10% is added at checkout and shown before you pay. Customers outside Australia are not charged GST. You may enter your ABN at checkout so that it appears on your tax invoice.
Subscriptions. Paid plans are billed monthly or annually as selected. You may cancel at any time, and your access continues until the end of the current billing period. Refunds are not provided for partial billing periods. Feasibly reserves the right to change pricing with 30 days' written notice.
One-off purchases. Single site reports and credit top-ups are charged once, are not subscriptions, and do not renew. Purchased top-up credits do not expire and are not reset at your billing date, unlike a plan's monthly allowance. A plan's monthly allowance is consumed before purchased credits.
Nothing in this section limits your rights under the Australian Consumer Law, including where a service is not supplied with due care and skill.
Limitation of liability.
To the maximum extent permitted by Australian law, our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the lesser of (a) AUD $10,000 or (b) the total fees paid by you to Feasibly in the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian consumer law.
Indemnification.
You agree to indemnify, defend, and hold harmless Feasibly and its operators, directors, employees, and agents from and against all claims, liabilities, losses, costs, and damages arising from your use of or reliance on the Service. This indemnity survives termination.
Intellectual property.
The Service, including its rule engine, zone schedule databases, user interface, and documentation, is the intellectual property of Feasibly and its operators. Government data is attributed to the relevant government authority and used under applicable open data licences (including Creative Commons Attribution 4.0 International).
Termination.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

We may modify these Terms at any time. Material changes will be communicated via email at least 14 days before the changes take effect.
